LEGAL NOTICE

On Wednesday, July 8, 2009 at 7:00 p.m., the Lake County Planning Board will hold a public meeting in the large conference room of the Lake County Courthouse on the following items:

 

PHEASANT FARM MINOR SUBDIVISION

Monte Peterson, Fredrick and Gretchen Schnitzer, and the David Levenson Revocable Trust have proposed a three (3) lot minor subdivision of ±80.21-acres located approx. 2.5 miles northeast of St. Ignatius in a 20-acre per dwelling unit density region. Hillside Road borders the property to the west. As proposed, the 3 lots would be used for single-family residential/agricultural purposes and be served by individual wells and septic systems. The lot is currently developed with a hayshed. The property is irrigated under the Flathead Irrigation Project. The parcel is legally described as S ½ NW ¼ of Section 8, T18N, R19W.

 

HIDDEN ROCK SUBDIVISION

A SUBSEQUENT MINOR SUBDIVISION

Peter and Rene Nazelrod have proposed a single-lot subsequent minor subdivision of a ±4.82-acre property containing approx. 463-feet of Flathead Lake frontage. The property is located 8 miles northeast of Polson along the west side of MT Hwy 35 in the Finley Point Zoning District, Sub-Unit A: Highway Lakeside. The zoning regulations require a minimum average density of 1.5-acres. As proposed, the lots would be 1.82 and 3.00-acres in size for single-family residential purposes. They would be served by individual wells and septic systems. Tract 2A is developed with an existing building. Tract 2B is developed with a house, guest house, garage, and shed.  The property is legally described as Tract 2 of Subdivision Plat (SP) 194 located in a portion of the W ½ of Section 15, T23N, R19W.

 

The application materials for the proposals may be viewed at Lake County Planning Dept, Room 315 of the Lake County Courthouse. The Lake County Planning Board encourages the public to attend this meeting and voice comments they may have on the proposals. The Planning Dept will accept written comment to be included in the Planning Board information packets. Public comment regarding water and/or sewer proposals must be submitted in writing to the Lake County Planning Dept.  This comment must be received prior to 5:00pm on June 29, 2009. Written comments received after that time will be synopsized and read aloud at the meeting. LEGAL NOTICE

On Wednesday, July 8, 2009 at 4:00 pm, the Lake County Board of Adjustment will hold a public hearing in the large conference room of the Lake County Courthouse on the following items:    

 

HAMLIN CONDITIONAL USE & VARIANCE REQUEST

Ed Hamlin has requested a conditional use and variance for a single-family residence on Lot 166 of Swan Sites, located within the Swan Sites Zoning District, Sub-Unit One.  The request is for a conditional use to allow impervious surface coverage between 30 to 49% of the buildable area of the lot, and a variance to allow development in an area designated as 100-year floodplain.  The lowest floor of the structure is proposed to be located 2 feet above the base flood elevation, in accordance with the Lake County Floodplain Regulations.  The property is 0.62-acres in size and is legally described as Lot 166 of Swan Sites, located in Section 14, T26N, R19W.

 

JOHNSON DENSITY VARIANCE REQUEST

Marc W. Johnson is requesting a variance to the Lake County Density Map and Regulations. The applicant is seeking a variance to the number of allowable development units for his 4.443-acre parcel located within a “2.5-acres per unit Development Density Region”. The applicant intends to apply for subdivision to create two parcels from the property, and the acreage of the parcel is less than the 4.5-acres that would be required to divide the property after applying the Density Regulations’ plus or minus 10 percent provision. The subject property is located approximately 2-miles SE of Ferndale at 12345 Halversen Dr, and is legally described as Parcel “A” of COS 6215, located within Section 2 of T26N, R19W.

 

ELLIS VARIANCE REQUEST

On behalf of the Ellis Family Limited Partnership of 1518 Green Tree Lane, Duncanville TX   75137, Scott and Lois Ellis have requested a variance to the Polson Development Code for property located at 39773 Baypoint Rd within the Polson City/County Zoning Area - Rural Residential Zoning District (RRZD). The request is to allow an accessory structure to contain a game room, storage area, and guest quarters. The property is 5.09-acres in size and is legally described as Lot 1 of Patterson’s Villa located in Section 29, T23N, R20W.

 

The complete applications and plans may be viewed at the Lake County Planning Dept, Room 315, of the Lake County Courthouse. The Board of Adjustment encourages the public to attend this meeting and voice comments they may have on the proposals. The Planning Dept will accept written comments on the proposal to be included in the information packets sent to the Board of Adjustment. This comment must be received prior to 5:00 pm on June 29, 2009. Written comments received after that time will be synopsized and read aloud at the meeting.
