On Oct. 17, 2011, the Federal Emergency Management Agency (FEMA) provided the communities (Lake County & municipalities) with preliminary copies of the Flood Insurance Study (FIS) report and Flood Insurance Rate Maps (FIRM). FEMA finds it appropriate to modify the 1‑percent-annual-chance Base Flood Elevations (BFEs) for Swan Lake, Johnson Creek, Dayton Creek, Post Creek, and Mission Creek. This courtesy notice is being provided by Lake County because to record owners of property along these drainages identified as having a new or modified BFE.
Official public notification by FEMA will be provided by way of the Lake County Leader on or about January 5 & 12, 2012. The notices will indicate that the proposed modifications in BFEs are posted on the FEMA website at:
The BFEs for the flooding sources are listed on the website in the table at the end of the BFE Notice for Studies. Also, the proposed BFE determinations can be obtained by calling the FEMA Map Information eXchange (FMIX), toll free, at 1‑877‑FEMA MAP (1‑877‑336‑2627). The draft FIRM may be viewed at the local city hall or the Lake County Courthouse.
These proposed BFEs, if finalized, will become the basis for the floodplain management in effect for the communities to remain qualified for participation in the National Flood Insurance Program (NFIP). However, before any revised BFEs are effective, there will be 90 days to appeal the proposed BFEs. During the appeal period following the second publication in the Leader, any owner or lessee of real property who believes his or her property rights will be adversely affected by the BFE determinations may appeal to the community agency, and copies of the appeals will be sent to FEMA. The sole basis for the appeals is knowledge or information indicating that the proposed BFE determinations are scientifically or technically incorrect. Inquiries regarding data other than the proposed BFE determinations (e.g., incorrect street names, typographical errors, omissions) will be considered as comments, rather than appeals. Comments are welcome but, unlike appeals, they are not required to be addressed in the current mapping effort. Any applicable changes will be made before the FIS report and FIRM become effective.
During the appeal period, citizens who want to appeal should present to the local governing community the scientific or technical data intended to negate or contradict FEMA’s findings. Any documents submitted without evidence that they were sent within 90 days of the second publication in the local newspaper will be considered comments.
